Terms of service
What these terms cover
These terms apply to paralegal, research, administrative and reception support we provide to law firms and other businesses. Your signed engagement letter sets out the scope, plan and price for your firm. If the engagement letter and these terms differ, the engagement letter applies.
We are a support provider, not a law practice
Luxe Consulting is not an Australian law practice and does not give legal advice. Everything we prepare is a draft for review, approval and supervision by your instructing Australian legal practitioner. You remain responsible for the legal work, for advice to your clients and for anything filed, sent or relied on.
Your responsibilities
- Give clear instructions, precedents and access to the systems we need.
- Review our work before it is used, and supervise it as your professional obligations require.
- Tell your clients about offshore support where your conduct rules or costs disclosure obligations require it.
- Keep trust account transactions, court lodgements and client advice within your firm.
Our responsibilities
- Do the work with reasonable care and skill, within the agreed turnaround.
- Have a team lead check work before it is returned.
- Correct drafts you return with mark-up at no extra cost.
- Keep your information confidential and handle personal information as set out in our privacy policy and data processing agreement.
Fees and payment
Prices are in Australian dollars and exclude GST. Monthly plans are invoiced monthly in advance. Hour blocks are invoiced on purchase and must be used within 60 days. Payment terms are set out in your engagement letter.
Term and ending the arrangement
Monthly plans run month to month and either party can end them with 30 days' written notice. Hour blocks have no ongoing commitment. When the arrangement ends we return or delete your information as the data processing agreement requires.
Work product
Drafts and documents we prepare for you belong to your firm once the relevant invoice is paid. Your precedents and materials remain yours throughout.
Conflicts
We screen new matters against our client list. If we find a possible conflict, we tell you and do not assign the work to anyone working for the other side.
Liability
To the extent the law allows, our total liability for any claim relating to our services is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect or consequential loss. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
Governing law
These terms are governed by the laws of South Australia, and the courts of South Australia have jurisdiction.
